Associations forms

Form 1: Application for Incorporation of Association
Form 1 - Application for incorporation of association must be lodged in order to incorporate an association. This form must be accompanied by Form 3: Application for reservation or extension of reservation of name (unless the name has previously been reserved).
If the public officer is to be someone other than the applicant, you must also lodge Form 9: Notice of vacancy/appointment/change of address of public officer.
Form 3: Application for Reservation or Extension of Reservation of Name
The proposed name of an association must be reserved before a Form 1: Application for incorporation of association or Form 4: Application for approval of change of name is lodged, to ensure the proposed name is available.
There are a small number of words where the use in a proposed name is prohibited or which may require further approvals and/or supporting evidence. These words include but are not limited to 'foundation, 'trust', 'trustee', chamber of commerce'. More specific details are available from the Registry.
Form 4: Application - For Approval of Change of Name
To change the name of an incorporated association a Form 3: Application for reservation or extension of reservation of name must be lodged to obtain confirmation that the proposed name is available. Form 4: must be lodged within one month of the general meeting at which an incorporated association has passed a special resolution to change the association’s name. The current certificate of incorporation must also be lodged with the Form 4.
Form 6: Notice of Alteration of Objects or Rules
This form is to be lodged within one month of the general meeting at which an incorporated association has passed a special resolution to change its object or rules. The alteration will take effect when the notice is accepted for lodgement. The association will be notified when the rule alteration is accepted.
Form 9: Notice of Vacancy/Appointment/Change of Address of Public Officer
This form must be lodged with the Office of Fair Trading within 14 days after (1) the position of public officer becomes vacant or (2) the appointment of a new public officer or (3) the change of address of the public officer.
Form 11: Application for Extension of Time for Holding Annual General Meeting or Lodging Statements
The public officer of an association is required to lodge an annual statement within one month of the annual general meeting. If the public officer is unable to lodge the annual statement in time or if the association wishes to delay its annual general meeting, an application should be made prior to the due date.
Form 12: Annual Statement
All associations incorporated under the Associations Incorporation Act 1984 are required to hold an annual general meeting (AGM) within 6 months after the end of its financial year and at least once in each calendar year. Within one month of holding the AGM the public officer is required to lodge an annual statement.
The statement of income and expenditure and assets and liabilities, which was presented to members at the AGM must accompany the Form 12.
Form 15: Application for Incorporation of an Amalgamated Incorporated Association
This form is used where two or more incorporated associations wish to amalgamate into the one association. Form 16: Notice of special resolution approving amalgamation of incorporated associations must be lodged with this form.
This form must be accompanied by Form 3: Application for reservation or extension of reservation of name (unless the name has previously been reserved).
Form 16: Notice of Special Resolution Approving Amalgamation of Incorporated Associations
This form is a notice of the special resolution passed by each incorporated association that is amalgamating. This form must be lodged with Form 15: Application for incorporation of an amalgamated incorporated association.
Form 18: Application for Incorporation by Company or Co-operative
This form must be lodged by a company or a co-operative making application for incorporation as an incorporated association under the Associations Incorporation Act 1984. This form must be accompanied by Form 3: Application for reservation or extension of reservation of name (unless the name has previously been reserved).
Form 21: Certificate of Public Officer as to Vesting of Property
This certificate certifies that property belonged to an unincorporated association, or was held by another person in trust for the unincorporated association, immediately before incorporation of the association.
Form 23: Application for Cancellation of Incorporation as an Association
This form is used to apply for the cancellation of incorporation of an association in New South Wales. A certified copy of the special resolution passed by members must be attached to the form.
