Property agents forms
The Property Stock and Business Agents Act 2002 requires that forms approved by the Commissioner for Fair Trading be used in relation to specific activities.
These are:
Section 35 form for a licensee to notify the Commissioner of a franchising agreement that has been entered into. This form is to clarify responsibilities and lines of accountability because under s35(2) of the Act, franchisors need to inform the Office of Fair Trading in writing within 7 days after becoming aware of any failure to account by a licensee who is a party to the franchising agreement.
