Child restraints

The Fair Trading Amendment (Child Restraints) Regulation 2009 is effective from 31 July 2009.

The Fair Trading Amendment (Child Restraints) Regulation 2009 updates the product safety standard for child restraints.  The Regulation prescribes the 2004 Australian/New Zealand Standard entitled AS/NZS 1754:2004 (Incorporating Amendment No. 1), Child restraint systems for use in motor vehicles, in addition to the 1995 and 2000 versions of that standard (AS/NZS 1754:1995 and AS/NZS 1754:2000).  

The safety standard complements the Commonwealth Regulation for Child Restraints which commenced on 1 October 2007.

The standard has been included in the Fair Trading Regulation, as provided for under section 26 of the Fair Trading Act 1987 which allows mandatory safety standards to be made that control performance, design or methods of manufacture, of a specific kind of goods supplied in trade or commerce.  The purpose of such requirements is to prevent or reduce the risk of injury to a person.

The child restraints safety standard will capture unincorporated businesses supplying and distributing child restraints in NSW.
