Holiday Parks (Long-term Casual Occupation) Regulation 2009
In accordance with requirements in the Subordinate Legislation Act 1989, the Holiday Parks (Long-term Casual Occupation) Regulation 2003 was automatically repealed as of 1 September 2009.
A new regulation, the Holiday Parks (Long-term Casual Occupation) Regulation 2009 has been made to replace the repealed regulation. This new regulation commenced on 1 September 2009. The Regulation sets out the detail needed to enable the Holiday Parks (Long-term Casual Occupation) Act 2002 to be effectively administered and to support its objectives. The Regulation:
- sets out how park owners must deal with goods left on site by a long-term casual occupant after vacating the site, and
- prescribes a form for a warrant to enforce an order for possession.
The requirements for dealing with uncollected goods have been streamlined, so that a park owner no longer needs to advertise in a newspaper that uncollected goods have been placed in storage, and the notice to a person in respect of uncollected goods is no longer prescribed.
