Home warranty insurance scheme update 

The Minister for Fair Trading introduced the Home Building Amendment (Insurance) Bill 2009 into Parliament on Wednesday 6 May 2009. The Bill clarifies the losses that are covered by home warranty insurance contracts. It is the second part of a staged legislative program to clarify the scope of the home warranty insurance scheme following a recent decision of the Supreme Court. The first stage of the program was the Home Building Amendment (Claims) Regulation 2008. That amendment Regulation was an interim measure until Parliament could consider the current Bill.
 
The Bill is available on the Parliament of NSW website. The need for the Bill is explained in the Better Regulation Statement.

The Bill was passed by Parliament on 13 May 2009. The Home Building Amendment (insurance) Act 2009 commenced on 19 May 2009 being the date of assent. The Amendment Act is available on the official NSW Government website for online publication of legislation provided and maintained by the the Parliamentary Counsel at www.legislation.nsw.gov.au.
