Retail tenancy disclosure requirements

The Retail Leases Amendment Regulation 2010 introduced a new harmonised lessor’s disclosure statement which commenced on 1 January 2011.
 
Following the Productivity Commission’s 2008 report on Australia’s retail leasing industry, the Small Business Ministerial Council commenced work to enhance consistency of the retail tenancy regulatory framework.

After a significant program of assessment and consultation, a new model harmonised disclosure statement for lessors was developed. The harmonised statement made minor changes to the current NSW lessors disclosure statement and will result in significant benefits, such as:

  • lessees better informed of their rights and obligations under a tenancy agreement and able to make more informed business decisions about their lease;
  • reducing the regulatory burden on business, particularly those landlords operating across state borders.

The current Lessor’s disclosure statement will operate in NSW, Qld and Victoria.
