Comment on proposed legislation
New South Wales’ fair trading laws are kept up to date and relevant through regular reviews that involve the community and other stakeholders. As circumstances change, new laws may be introduced or older ones repealed.
When new or amended legislation is proposed we seek the broadest possible comment. The list below shows current topics open for comment. If comment has been invited on a published paper, you can view or print a copy from this page or contact us to have a hard copy posted.
Review of the regulation of motor vehicles
This review seeks comment on a proposal to combine the Motor Dealers Act 1974 and the Motor Vehicle Repairs Act 1980 and create a consolidated Act that provides for effective consumer protection in this industry.
Comments will be accepted up to 13 July 2012.
Plumbing and Drainage Regulation 2012
A draft Plumbing and Drainage Regulation 2012 has been released for public comment following the passing of the Plumbing and Drainage Act 2011 by Parliament on 9 November 2011.

Review of the Fitness Services (Pre-paid Fees) Act 2000
NSW Fair Trading is undertaking a review of the Fitness Services (Pre-paid Fees) Act 2000 as part of the NSW Government’s commitment to reducing red tape and ensuring that regulation is effective and necessary.

Standard contract for retirement villages
The NSW Government is committed to developing a standard contract for retirement villages. The objective of developing a standard contract is to make it easier for residents to compare and understand the differences in costs and conditions between villages before entering into a contract.
Comments will be received until 18 May 2012.

Review of strata and community title laws
The New South Wales Government is carrying out a comprehensive review of NSW strata and community title laws.
The review commenced in December 2011 with an online consultation forum hosted by Global Access Partners. The online forum closed on 29 February 2012. To view all published comments go to www.openforum.com.au/strata

Legislation covered by the review
The review covers all five Acts that regulate the development and management of strata and community schemes:
- Strata Schemes Management Act 1996 and Strata Schemes Management Regulation 2010.
- Strata Schemes (Freehold Development) Act 1973 and Strata Schemes (Freehold Development) Regulation 2007.
- Strata Schemes (Leasehold Development) Act 1986 and Strata Schemes (Leasehold Development) Regulation 2007.
- Community Land Management Act 1989 and Community Land Management Regulation 2007.
- Community Land Development Act 1989 and Community Land Development Regulation 2007.
Review of the Residential Parks Act 1998
As part of the NSW Government’s residential parks policy commitments, a review of the Residential Parks Act 1998 is being carried out.
A discussion paper was released for public consultation in November 2011. Submissions in response to the paper have now closed.
