Trader fined for ignoring toy safety

21 May 2010

A Rockdale trader has been ordered to pay almost $3,000 by Parramatta Local Court for supplying dangerous children’s toys that pose a serious choking hazard.

Mainleading Pty Ltd, trading as Rockdale Shopping Paradise, pleaded guilty to two breaches of section 27(1) of the Fair Trading Act 1987 for failing to comply with the product safety standard.

The dangerous toys included a “clown phone” and “beautiful toy phone play set”.

Fair Trading Minister Virginia Judge said rigorous testing revealed these toys presented a potentially fatal choking hazard due to small parts.

“There is no excuse for selling toys that put children’s lives at risk,” she said.

“Unfortunately, this is the second time this company has been convicted for supplying dangerous toys.

“The law is very clear when it comes to the supply and sale of unsafe toys, if it doesn’t meet the standard it should not be on the shelf.

“Any toy containing small pieces that breaks after being dropped, twisted or pulled can cause potential injury or death to a small child.

“Traders caught breaching the law face fines of up to $110,000 for corporations and $22,000 for individuals.”

Ms Judge said the Court’s decision should serve as a strong warning to traders who are thinking of doing the wrong thing.

“Product safety is a key priority for the NSW Government,” Ms Judge said.

“That’s why Fair Trading carries out more than 1000 random inspections every year to prevent dangerous toys from being sold in the marketplace.

“We have seen a significant decline in the number of non-compliant toys being sold in NSW over the last few years which is great news for mums and dads.”

Fair Trading will continue to monitor the activities of Mainleading Pty Ltd.
