Public warned about "Men's Health" promoter - Guy Hudson

NSW Fair Trading Deputy Commissioner Steve Griffin has issued a public warning about Guy Hudson under section 86A of the Fair Trading Act. Mr Hudson is a director of two companies which promote treatment programs and products for sexual health issues – Supplemax Pty Ltd and Superior Men’s Health Pty Ltd.
Mr Griffin said Supplemax, which was the subject of a public warning by Fair Trading in August this year, ceased trading in October and went into voluntary liquidation with a liquidator appointed on 8 December 2010.
“NSW Fair Trading received nearly 300 complaints or enquiries about Supplemax, the majority about the company’s business practices, with many relating to non supply of products.”
Mr Griffin said that many of the complaints are about Mr Hudson operating in a manner likely to result in severe financial loss to the individual consumer.
“These complaints show Mr Hudson was prepared to take advantage of vulnerable consumers for financial benefit,” he said. “On 15 September 2010, Mr Hudson registered a new company, Superior Men’s Health Pty Ltd (ACN 146 358 036) with ASIC, offering medical programs and products for the treatment of male sexual health problems.
“To date no complaints have been received by Fair Trading in relation to this business. It appears from the date Superior Men’s Health was registered that Mr Hudson knew he would be winding up Supplemax, yet he continued to sign up customers for the treatment it offered.”
Mr Griffin said Mr Hudson had advised Fair Trading on 13 December he was closing down Superior Men’s Health Pty Ltd.
“Fair Trading is closely monitoring the wind-down of the business,” he said. “Fair Trading was about to commence injunction proceedings against Mr Hudson and his companies when it was informed that Mr Hudson was getting out of the men’s health industry altogether.”
Mr Griffin said Fair Trading’s investigations were a key element in Mr Hudson’s decision.
“Should Mr Hudson reappear in the industry those legal proceedings will be immediately revisited,” he said.
Mr Griffin said both businesses posed a special risk to vulnerable consumers and, due to the sensitive nature of the goods and services provided by the companies, it was reasonable to assume complaints were under-reported, with many customers too embarrassed to complain.
“Fair Trading will continue to examine possible legal action against Mr Hudson,” he said.
