Roberts congratulates New England builders

Fair Trading Minister Anthony Roberts today congratulated New England builders after checks by Fair Trading inspectors last week unearthed only one breach of legislation.

Mr Roberts said inspectors visited 70 new home building sites and renovation sites in the region and spoke to 121 people, to ensure compliance with the Home Building Act 1989 and Electrical (Consumer Safety) Act 2004 and associated regulations.

One penalty notice for $750 was issued to an individual in Armidale for unlicensed contracting.

The Minister said the results were testament to the integrity of the local home building industry and to the importance of Fair Trading’s presence in the marketplace.

“Fair Trading undertakes these kinds of operations routinely throughout the year across the state, to keep industry educated and informed about their rights and responsibilities,” he said. “It’s good for the industry and good for consumers.

“The Coalition Government will ensure consumers are protected when they make major purchasing decisions like building or renovating their home.

“Consumers are not fully protected and able to access remedies for defects or unsatisfactory work unless they are doing business with licensed, qualified and law abiding builders or tradespeople.

“Traders benefit from industry regulation and oversight because unlicensed and dodgy operators are excluded from business. We must have a level playing field.”

On the spot fines under the Home Building Act 1989 range from $250 for an individual and $500 for a corporation to $1500 and $3,000 respectively, depending on the breaches involved. Maximum court ordered fines are: $22,000 for individuals and $110,000 for companies and partnerships.

On the spot fines under the Electrical (Consumer Safety) Act 2004 range from $200 for an individual or corporation for minor matters and up to $5,000 for an individual or $10,000 for a corporation. Maximum court ordered fines are: $55,000 for an individual and $825,000 for a corporation.

The ultimate sanction for continuing to operate in the industry without a licence is a visit to the Supreme Court and gaol, for breaching court orders.

Mr Roberts encouraged people to check trade licences at Fair Trading website or by calling 13 32 20.
