Product safety bans
Prohibition orders
Only the Commonwealth Minister can impose permanent bans on the supply of a dangerous product or ban its supply if it does not meet certain conditions. Bans imposed under the Australian Consumer Law can be either interim (which last for 60 days) or permanent.
A list of banned products can be found on the Product Safety website www.productsafety.gov.au
If you are an importer, wholesaler, distributor or retailer of these products you are responsible to comply with these requirements.
Penalties for breaching certain product safety provisions range from $220,000 for individuals to $1.1 million for corporations.
