Second-hand goods

There are a number of implied warranties on second-hand goods purchased from a trader. These include:

  • goods must be of ‘merchantable quality’, unless the consumer is informed otherwise
  • goods must be fit for the purpose supplied
  • goods must be as described, or match the sample.

With second-hand goods the price, age and condition should be taken into account.

Goods bought second-hand at auction are not covered by implied warranties.
