Second-hand goods

Second-hand goods purchased from a trader have statutory (or implied) warranties  which require goods to:

  • be and remain free of debt, charges or mortgages - have 'clear title', unless this debt is disclosed or known to you before you agree to buy the goods
  • be of ‘merchantable quality’ - meet the basic level of quality and performance expected, considering their description, price and other relevant circumstances unless you are informed otherwise
  • fit their intended purpose 
  • match any description or sample.

With second-hand goods the price, age and condition should be taken into account.

Second-hand goods bought at auction are not covered by statutory warranties. However, the seller is obliged to provide 'clear title' unless any debt, charge or mortgage is disclosed or known to you before you agree to buy the goods.
