Case study - buying a car and contracts

Matt standing next to car and talking to Fair Trading OfficerMatt bought a car and entered into a contract with a car dealership. He was so eager to finalise the sale that he signed a waiver for the cooling-off period. He didn’t think twice about it until he saw his work mates later that day and they said:

“What are you doing? You’ve entered into a legally binding contract!”

Matt got scared and tried to ring the dealership to get out of the deal, saying he’d changed his mind and didn’t want the car anymore. However, the dealership didn’t want to negotiate.

Matt learned about the Office of Fair Trading through a friend and rang for some advice. The Fair Trading officer talked through the problem with Matt and asked him to put it in writing and he’d see what could be done. Fair Trading then contacted the dealership to try and resolve the problem.

In the end, Matt lost his deposit, but was able to get out of the contract, which was the outcome he wanted.
