Statutory authorities and advisory bodies

The NSW Fair Trading portfolio includes a number of statutory authorities and advisory bodies that have been established to perform a diverse range of functions. They each contribute to fair trading in New South Wales.

Fair Trading Administration Corporation

The Fair Trading Administration Corporation (FTAC) administered insurance claims against the government-run insurance schemes that were in place in New South Wales to protect consumers from loss where a homebuilder performed faulty or incomplete work or became insolvent.

It should be noted that no further claims are possible under the Scheme and the Corporation is in the process of being closed.

Rental Bond Board

The Rental Bond Board is the independent custodian of rental bonds paid by tenants to landlords for residential tenancies. Landlords must lodge tenants' bond money with the Board. NSW Fair Trading's Rental Bonds branch administers the Board's day to day functions, providing rental bond lodgement, custody, refund and information services.

The income earned from investing the bonds is used to fund the Board's operating costs, rental advisory services, and other programs and projects which benefit the residential tenancy sector. Strict guidelines, however, govern the use of the investment income from bonds and the bond money itself is quarantined, at all times.

The Department of Finance, Services and Innovation carries out the Board's Secretariat functions.

Building Professionals Board

The Building Professionals Board accredits and regulates certifiers in NSW. Accredited certifiers work for councils or in the private sector, and inspect and certify buildings, various structures and subdivisions.

The Board is part of Fair Trading's Specialist Services. The Board’s contact details can be found on the contact page of the Board’s website.

NSW Architects Registration Board

From 29 May 2015 the Architects Act 2003 was allocated to the administration of the Minister for Innovation and Better Regulation who is also responsible for NSW Fair Trading.

Professional Standards Council

From 29 May 2015 the Professional Standards Act 1994 was allocated to the administration of the Minister for Innovation and Better Regulation who is also responsible for NSW Fair Trading.

Advisory bodies

Ministerial Advisory Councils

The Ministerial advisory councils were established under the Fair Trading Act 1987 and Home Building Act 1989 to provide advice to the Minister.

New South Wales Products Safety Committee

The Products Safety Committee carries out investigations into the safety of products as referred by the Minister for Fair Trading.
