This is a list of public warnings about unfair business practices and people who engage in them.

  • Public warnings are issued depending on the circumstances of each case.
  • Public warnings are different to our complaints register which lists companies that have received more than 10 complaints in a month.

What is a public warning?

The warning may identify and give information about:

  • goods that are unsatisfactory, or supplied in an unsatisfactory manner, and the people who supply them
  • unfair business practices and the people who have engaged in them
  • other matters that adversely affect, or may adversely affect, people receiving goods or services from suppliers.

These warnings are issued with regard to the circumstances of the case, the stage of the investigation and the parties involved in the matter, and in compliance with privacy law.


Consumer Affairs Victoria have issued a public warning about Anahata Global Pty Ltd trading as ISHKA

19 February 2024

Ishka is largely an online furniture and retail store, with one large superstore located in Clayton, Victoria.

There has been a spike in complaints in Victoria and NSW about this Victorian based retailer, relating to supplying goods, providing refunds and responding to customers.

If you have purchased goods from ISHKA but have not received them, you may be able to ask your bank or card provider for a charge-back or raise a dispute with your online payment provider, depending on how you paid for the goods.

Consumers warned not to deal with Ahmad Jaber trading as iScope Cleaning Services, Metro Cleaning, Sydney’s Best End of Lease Cleaning, Fantastic Cleaning and others

NSW Fair Trading Commissioner, Ms Natasha Mann, is warning consumers not to deal with Ahmad Jaber who trades and has traded using the below unregistered business names:

  • iScope Cleaning and iScope Cleaning Services
  • Metro Cleaning and Metro Cleaning Services
  • Sydney’s Best End of Lease Cleaning
  • Fantastic Cleaning or Fantastic Cleaners

Mr JABER offers residential and commercial cleaning services across Sydney including end of lease cleaning services which he advertises as coming with a rental bond back guarantee.

Since 2019, NSW Fair Trading has received 83 complaints and 17 enquiries regarding the above businesses operated by Mr Jaber.

In 2023, NSW Fair Trading was contacted 34 times by consumers who reported that they paid Mr Jaber for cleaning services that were either not provided, not provided within the timeframe agreed or were not completed to a satisfactory standard. Most consumers also report that Mr Jaber fails to provide them with proof of payment, such as a tax invoice or receipt.

Mr Jaber has advertised his services via the business websites, on Gumtree and via websites such as Hipages and Service Seeking. Mr Jaber uses several aliases including Ahmad, Adam, Alex, Adam Jay, Alex Jay and AJ.

In addition to the complaints received, NSW Fair Trading has identified that the websites linked to the businesses operated by Mr Jaber including "iscopecleaning.com.au" and "metrocleaning.com.au" currently display and/or have previously displayed the NSW Fair Trading logo, the Real Estate Institute of NSW logo, and NSW Tenants Union logo without  approval from those organisations. NSW Fair Trading has also identified that some of the Gumtree advertisements published by Mr Jaber state that the businesses operated by him are “NSW Fair Trading recommended”.

Ms Mann is urging consumers, and renters in particular, to exercise caution when booking  cleaning services. Ms Mann is also reminding consumers that:

“NSW Fair Trading is an impartial regulator and we do not recommend businesses to the consumers of New South Wales. People who attempt to promote their businesses using the NSW Fair Trading logo or by implying that they are approved by NSW Fair Trading are doing the wrong thing and we will take necessary action against those found to be doing it.”

Consumers warned not to deal with Andrew Perez trading as Affordable Property Maintenance APM Pty Ltd

2 July 2023

NSW consumers are being warned not to deal with Andrew Perez trading as Affordable Property Maintenance APM Pty Ltd.

Mr Perez is unlicensed and NSW Fair Trading has received complaints that he made false and misleading statements to customers who contracted and paid him for residential building services. It is alleged Mr Perez has not completed work he was paid for and has refused to fully refund customers.

NSW Fair Trading reminds consumers to be wary of tradespeople who claim to be licensed. Always check for a licence via the online register and never hand over money without first meeting your tradesperson. A licence is required for all specialist work such as electrical, plumbing and air conditioning regardless of the cost. Further, a licence is required for all other residential work valued at more than $5,000.

The Home Building Act 1989 prohibits seeking more than 10% of the contract price as a deposit prior to starting residential building work. Under the Home Building Act 1989, a written contract must be provided to the homeowner for building work above $20,000, and a small jobs contract is required for all work costing from $5,000 to $20,000.

Consumers warned not to deal with SPG Consultants Pty Ltd trading as Tru Water

4 June 2023

NSW Fair Trading Commissioner, Ms Natasha Mann, continues to warn consumers not to deal with SPG Consultants Pty Ltd trading as Tru Water, Tru Water AU, Tru Water (Aust), and www.truwater.com.au.

The online trader operates a business supplying and distributing water filtration products, systems, and accessories to consumers in Australia via website www.truwater.com.au. Commissioner Mann previously warned against dealing with SPG Consultants Pty Ltd on 29 July 2022.

Since that time, NSW Fair Trading continues to receive complaints about the business with complaints relating to non-delivery or delayed goods, misrepresentation of goods advertised on the website and substituted supply of pre-paid online orders.

Between August 2022 and April 2023, the business has appeared on NSW Fair Trading’s public complaints register every month.

Anyone who has dealt with SPG Consultants Pty Ltd, www.truwater.com.au or the business names listed above, and is not satisfied with their interaction, is urged to submit a complaint to NSW Fair Trading.

Consumers warned not to deal with Bloomex Pty Ltd

20 April 2023

Commissioner for Fair Trading Ms Natasha Mann has warned consumers not to deal with Bloomex Pty Ltd trading as ‘Bloomex’ and https://bloomex.com.au/.

Bloomex is a registered Australian company, with its parent company based in Ottawa, Canada.

Bloomex is an online supplier of local and imported floral arrangements and gift baskets. Bloomex makes claims on its website that it is ‘Australia’s National Florist’ and offers ‘same day’ delivery service for orders placed before 1:00pm.

Ms Mann said the warning comes following a rise in complaints from consumers about not receiving pre-paid goods within a promised timeframe, receiving items that are materially different to what was advertised on the Bloomex website and receiving items that are of poor quality.

Consumers have reported finding it difficult to contact Bloomex to discuss delays and there does not appear to be an effective complaint handling process, making it difficult for urgent concerns to be resolved.

Bloomex appear not to offer appropriate financial redress to its customers unless NSW Fair Trading intervenes.

On 18 December 2022, the ACCC commenced its own proceedings against Bloomex in the Federal Court of Australia for alleged discount misrepresentations, misleading star reviews and total minimum price contraventions displayed on its website.

Home Appliances Plus / Steel & Water Pty Ltd

13 February 2023

The Western Australian Government was issued a warning against a national online retailer, Home Appliances Plus / Steel & Water Pty Ltd, which has attracted a large number of complaints relating to non-delivery of goods and failing to provide refunds.

Do not deal with All District Trades Pty Ltd

10 May 2023

NSW Consumers are being warned not to deal with All District Trades Pty Ltd (All District Trades). As at 13 February 2023, Mr Ali El-Asmar and Mr Henrique Daniel Dolce were directors of All District Trades.

Between July 2020 and early 2023, NSW Fair Trading has received 78 complaints concerning All District Trades. Consumers complain that the company has accepted payment for goods or services without supplying those goods or services within a reasonable time and/or did not supply the goods or services at all. Complaints also concern the quality of works carried out.

Anyone who has had problems in their dealings in NSW with All District Trades Pty Ltd should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

Consumers are warned against handing over payment prior to meeting a trader and prior to the commencement of work. Consumers are also urged to check that their tradesperson is appropriately licensed to do the work.

Do not deal with Gareth James Bryant

5 April 2023

Commissioner for NSW Fair Trading, Ms Natasha Mann, today warned consumers not to deal with Gareth James Bryant. NSW Fair Trading understands that Mr Bryant has traded under various company and business names in New South Wales, including:

  • Brycon Group Pty Ltd
  • Brycon Constructions
  • Outbuild Pty Ltd
  • Pure Lifestyle Renovations
  • Forever Green Landscape Constructions Pty Ltd.

Mr Bryant does not hold, and has not ever held, a current NSW contractor licence. NSW Fair Trading is concerned that Mr Bryant is attempting to contract to do residential building work without holding a licence. NSW Fair Trading is also concerned that in circumstances where Mr Bryant has contracted, he has not provided the services contracted for and has not refunded substantial payments made by consumers. Consumers complain that Mr Bryant has made false and misleading statements inducing them to contract with him and to pay for services.

NSW Fair Trading reminds consumers to be wary of tradespeople who claim to be licensed. Always check for a licence via the online register https://verify.licence.nsw.gov.au/home and never hand over money without first meeting your tradesperson.

A licence is required for all specialist work such as electrical, plumbing and air conditioning regardless of the cost. Further, a licence is required for all other residential work valued at more than $5,000.

The Home Building Act 1989 prohibits seeking more than 10% of the contract price as a deposit prior to starting residential building work. Under the Home Building Act 1989, a written contract must be provided to the homeowner for building work above $20,000. A small jobs contract is required for all work costing from $5,000 to $20,000.

Do not deal with Duanne Hevers

NSW Fair Trading Commissioner, Ms Natasha Mann, today warned consumers not to deal with Mr Duanne Hevers who has traded in NSW under the business name Fairwater Plumbing.

Mr Hevers does not and has not ever held a NSW contractor licence. Based on complaints received from consumers, NSW Fair Trading is concerned that Mr Hevers may be seeking to trade without a licence. Consumers have complained that Mr Hevers seeks residential building work for which a licence is required and makes false and misleading statements to obtain money from them.

NSW Fair Trading reminds consumers to be wary of tradespeople who claim to be licensed. Always check for a licence via the online register and never hand over money without first meeting your tradesperson.

A licence is required for all specialist work such as electrical, plumbing and air conditioning regardless of the cost. Further, a licence is required for all other residential work valued at more than $5,000.

Do not deal with National Fire & Safety Pty Ltd and Michael Robson

9 January 2023

Consumers are being warned not to deal with National Fire & Safety Pty Ltd (ACN 649 300 845) or Mr Michael Robson, the sole director of the company, in relation to services for which accreditation by the Fire Protection Association of Australia (the FPAA) is required. The company uses the website https://www.nationalfiresafety.com.au/ to advertise services.

Consumers have complained that the company and Mr Michael Robson have offered and supplied fire protection services, for which accreditation by the FPAA is required, including assessments for annual fire safety statements, in circumstances where neither Mr Michael Robson nor employees of the company held the appropriate accreditation.

On 10 August 2021, the FPAA indefinitely suspended Mr Michael Robson’s Fire Safety Assessment accreditation (Accreditation No. F054451A). As such, Mr Michael Robson does not hold accreditation to undertake assessments for annual fire safety statements.

Under the Building and Development Certifiers Act 2018, persons who undertake regulated work (which includes certain fire protection services) are required to be accredited to do so. Consumers can check whether a person holds accreditation with the FPAA by visiting http://www.fpaa.com.au/.

Do not deal with Trent Travis Reid

9 January 2023

NSW Consumers are being warned not to deal with Trent Travis Reid and who is understood to trade through business names including Transitions Roof Restorations, Toppride Roofing, Reids Roofing, Reids Roof Restoration, and Triple A Roofing and who has used a business name registered to an unrelated person.

Mr Reid does not hold a licence under the Home Building Act 1989 authorising him to contract for or perform residential building work.

NSW Fair Trading has received several complaints about Mr Reid. The complaints received relate to consumers who contracted with Mr Reid for various works, such as roof repairs,roof restorations and alterations, roof gutter and downpipe repairs, driveway restoration,pressure cleaning, and painting.

Consumers reported that work done by Mr Reid is left in a defective and incomplete state,that Mr Reid has caused damage to property, has taken excessive deposit monies, has provided misleading representations about guarantees on his work and failed to refund his customers when they complain.

Anyone who has had dealings with Mr Reid should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

2022 public warnings

Do not deal with Open Close It Pty Ltd trading as Shutters Quickly which operates the website www.shuttersquickly.com.au

14 November 2022

NSW Consumers are being warned not to deal with Open Close It Pty Ltd trading as Shutters Quickly. The sole director of the company is Mr Nicholas Paxinos.

Shutters Quickly operates to supply and install blinds, plantations shutters and security shutters. The company uses the website www.shuttersquickly.com.au to promote its business.

Since 27 January 2022, NSW Fair Trading has received 76 complaints about Shutters Quickly. Some complaints relate to consumers paying large deposits for the supply and installation of blinds or shutters in circumstances where the company has failed to complete installations or provide refunds.

Consumers also complain that the business is unresponsive to attempts to contact by email and telephone to discuss issues including failures to supply or refund.

Commissioner for Fair Trading, Natasha Mann is urging consumers to read their terms and conditions and check for reviews on businesses prior making any decisions, and to inform themselves as much as possible before paying large deposits or entire transaction amounts to traders prior to receiving any goods or services.

Do not deal with Festival Ignite Pty Ltd trading as Dinosaur Festival Australia which operates the website dinofestivalaustralia.com

NSW Fair Trading Commissioner, Natasha Mann, has today warned consumers not to deal with Festival Ignite Pty Ltd trading as Dinosaur Festival Australia which operates the website dinofestivalaustralia.com.

The company has operated a travelling family entertainment events business, exhibiting life size animatronic dinosaurs which make realistic noises and movements. The events are advertised through the Dinosaur Festival Australia website and multiple Facebook pages. The company has advertised events to be held in areas of NSW including Sydney, Gosford and Newcastle.

Since 16 August 2021, NSW Fair Trading has received a total of 76 complaints and 16 enquiries against the company. The complaints relate to continued postponement or cancellation of events for which the consumers purchased tickets, refusal by Festival Ignite Pty Ltd to provide any refund and the continued offering for sale of tickets for events after cancellation of those events.

Anyone who has dealt with Festival Ignite Pty Ltd trading as Dinosaur Festival Australia and is not satisfied with their interaction is urged to lodge a complaint with NSW Fair Trading via the Fair Trading website or call 13 32 20.

Do not deal with SPG Consultants Pty Ltd which operates the website truwater.com.au using the business names Tru Water AU, Tru Water (Aust) and Tru Water

NSW Fair Trading Commissioner, Natasha Mann, has today warned Consumers not to deal with SPG Consultants Pty Ltd who trade using the website www.truwater.com.au and the business names Tru Water AU, Tru Water (Aust) and Tru Water (Tru Water).

The company supplies and distributes water filtration products, systems, and accessories to consumers in Australia via the website.

SPG Consultants Pty Ltd assumed management of the business from the previous Tru Filter Group Pty Ltd in 2019.

Since April 2020, Fair Trading has received 355 complaints and 164 enquiries concerning the website, the company and the business names. Consumers complain about delayed and partial delivery of orders, products substituted without customer consent and misrepresentation of goods advertised on the website.

Do not deal with Green Magic Homes Australia Pty Ltd

19 May 2022

NSW Consumers are being warned not to deal with Green Magic Homes Australia Pty Ltd ACN 628 254 320.

On 19 May 2022 NSW Fair Trading cancelled the contractor licence of Green Magic Homes Australia Pty Ltd.

As a result, Green Magic Homes Australia Pty Ltd is no longer able to advertise, contract for, or carry out any residential building work for which a licence is required in NSW.

Minister for Fair Trading Ms Eleni Petinos said “Anyone in NSW who has had problems in their dealings with Green Magic Homes Australia Pty Ltd or has information about their past operations or continued operation, are encouraged to contact NSW Fair Trading on 13 32 20 to lodge a complaint.”

Consumers are warned against handing over payment prior to meeting any trader and prior to the commencement of work. Consumers are also urged to check that their tradesperson is appropriately licensed to do the work.

Do not deal with Atomic 6 Pty Ltd

2 March 2022

NSW Consumers are being warned not to deal with Atomic 6 Pty Ltd, or its Director Andrew Lennox.

On 2 March 2022, NSW Fair Trading cancelled the contractor licence of Atomic 6 Pty Ltd.

Minister for Fair Trading, Ms Eleni Petinos said, “The licence cancellation means Atomic 6 cannot advertise, contract for, or conduct any residential building work in NSW for which a licence is required.”

“The company has been the subject of complaints about defective, incomplete and poor building work conducted without NSW Home Building Compensation Fund insurance.”

“Issuing a public warning about Atomic 6 is in the public interest to prevent further financial loss to consumers."

“Anyone in NSW who has had problems in their dealings with Atomic 6 Pty Ltd or has information about their past operations, should contact Fair Trading on 13 32 20 to lodge a complaint.”

A licence is required for all specialist work such as electrical, plumbing and air conditioning regardless of the cost. Further, a licence is required for all other residential work valued at more than $5,000.

The Home Building Act 1989 prohibits seeking more than 10% of the contract price as a deposit prior to starting residential building work.

Licensed contractors who take on residential work valued at more than $20,000 must-have insurance cover through the NSW Home Building Compensation Fund.

Consumers are reminded to always check a contractor is licensed to carry out the work prior to engaging them via the public register.

In catastrophic events such as bushfires, floods, and other natural disasters, it is even more important to be vigilant and ensure the people completing work on your home are appropriately qualified and licensed.

Anthony Lee Francis aka Tony Francis aka Anton Francis, Steel Bond Group, Hills District Fencing, Hills District Fencing and Gates NSW

3 March 2022

NSW Fair Trading Commissioner, Ms Natasha Mann, today warned consumers not to deal with Anthony Lee Francis also known as Tony Francis and Anton Francis who has traded in NSW under the business names Steel Bond Group, Hills District Fencing, Hills District Fencing and Gates NSW.

Mr Francis does not hold a current NSW contractor licence. Based on complaints received from consumers, Fair Trading is concerned that Mr Francis may be seeking to trade without a licence. Complaints indicate that Mr Francis seeks residential building work, mainly general concreting including driveways and footpaths, and has now moved onto fencing and is targeting the Hills District of NSW. Consumers complain that after contracting for the work and accepting payment, Mr Francis leaves the work incomplete or does not perform any work at all, and then does not refund consumers their money.

Mr Francis was the subject of a previous public warning made on 4 September 2018.

2021 public warnings

Deluxe Products Pty Ltd trading as Luxo Living

21 December 2021

Consumers are warned not to deal with Deluxe Products Pty Ltd (ACN 102 989 097) trading as Luxo Living (Luxo Living).

Luxo Living is a furniture and homewares retailer operating through the website www.luxoliving.com.au and from retail premises located at 160 Newtown Road, Wetherill Park NSW 2164.

Since 10 January 2020, Fair Trading has received complaints from 200 consumers dealing with Luxo Living. The majority of the complaints appear to be unresolved. Consumer complaints include that goods ordered and paid for are:

  • faulty or defective
  • not of an acceptable quality
  • do not match the description/image published on their website, or
  • not supplied.

Viagogo AG operating through the website https://www.viagogo.com

25 November 2021

Consumers are warned not to deal with Viagogo AG or purchase tickets through the ticket reselling platform it operates via the website https://www.viagogo.com.

Since 1 June 2018, Fair Trading has received 531 consumer complaints and 401 enquiries about the Swiss-based company, many of which relate directly to allegations of ticket scalping.

Other complaints received by Fair Trading allege that Viagogo AG has failed to supply consumers with tickets purchased by the date specified, issued consumers with tickets that differ from those advertised/purchased, made false and/or misleading representations about being an authorised ticket seller for certain events and failed to specify a single price for the tickets advertised for sale.

On 1 June 2018, new laws targeting ticket scalping were introduced in NSW making it an offence for a person to sell a ticket for more than 110% of the original supply cost of the ticket.

The Commissioner for Fair Trading, Rose Webb, is urging consumers to be cautious when dealing with off-shore businesses, particularly when it comes to purchasing tickets to events, noting that COVID-19 restrictions are easing and more ticketing events are available to consumers.

“When it comes to transactions between Australian-based consumers and off-shore businesses, it is imperative that consumers heed our warnings and refrain from doing business with international traders who refuse to comply with Australian law.”

Hong Thang Tran, Maris Building Group Pty Ltd, and A & J Group Services Pty Ltd

10 November 2021

NSW consumers are being warned not to deal with Hong Thang Dang Tran, Maris Building Group Pty Ltd, and A & J Group Services Pty Ltd.

Mr Tran is known to use many aliases including, Thuong Tho Pham, Dave the Builder, John Wilde, Elvis Tran, David Tran, Kevin Tran, Ethan Tran, Tommy Nguyen, Paul Lee and TT Building and Construction and is known to advertise on online community pages.

NSW Fair Trading have issued Mr Tran and associated companies fines totalling $19,500 from May 2020 to August 2020.

NSW Fair Trading has received complaints from consumers. Consumers complain that Mr Tran (including through corporate entities) has contracted to do residential building work without a licence to do so, advertised that he is willing to do residential building work he was not licenced for, contracted to do work requiring insurance under the Home Building Compensation Fund without obtaining any such insurance, and accepted substantial sums of money and without providing the services paid for.

Anyone who has had problems in their dealings in NSW with Mr Tran or the companies mentioned in this warning, or has information about their continued operation, should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

Consumers are also urged to check that their tradesperson is appropriately licensed to do the work.

NSW consumers are being warned not to deal with Zohaib Hassan, who trades under the name: Home Wants Furniture,.

Zohaib Hassan carries on an online furniture and homewares retailer business through the website: homewants.com.au

Consumers dealing with the trader complain that he has repeatedly accepted payment for products that he has failed to supply either fully or within the time specified.

Consumers also claim the trader has supplied faulty, or defective products and failed to remedy those matters.

Matthew Geoffrey Rixon aka Matthew Douglas aka Matt Douglas

NSW Consumers are again being warned not to deal with Matthew Geoffrey Rixon – or his suspected aliases “Matthew Douglas” and “Matt Douglas”.

This is one of many public warnings that Fair Trading has issued about Mr Rixon, after bringing multiple court proceedings against the unlicensed tradesman.

Mr Rixon mainly offers fencing services, on occasion decking and other renovation services.  Mr Rixon is known to receive deposits from consumers for work at their homes.  On some occasions a small amount of work is done before the work is abandoned, however on most occasions no work is done and consumers are left out of pocket.

Consumers are urged to be wary of traders advertising for fencing and decking work.  Consumers should be particularly wary of traders who ask for deposits over the internet without first coming out to your home.

Do not deal with Nillo Ashok Duggal, trading as 360 Degree Home Building Solutions Pty Ltd

NSW Consumers are being warned not to deal with Nillo Ashok Duggal who is currently trading under the name 360 Degree Home Building Solutions Pty Ltd.

Mr Duggal is advertising residential building work services on the internet using the name “360 Degree Home Building Solutions Pty Ltd”. That company has been deregistered.

Mr Duggal does not hold a contractors licence authorising him to contract to do residential building work.

Fair Trading has recently received complaints from consumers about Mr Duggal contracting to do structural landscaping work. The consumers complain that the work is unsatisfactory and uninsured.

In 2019, Mr Duggal was convicted by the Parramatta Local Court of seven offences under the Home Building Act 1989, (including for unlicensed contracting) and one offence under the Australian Consumer Law.

Anyone who has had problems in their dealings in New South Wales with Mr Duggal or 360 Degree Home Building Solutions Pty Ltd, or has information about his continued operation, should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

Do not deal with Tevita Tiliti Ungounga, also known as David Ungounga

NSW consumers are again being warned not to deal with Tevita Tiliti Ungounga

NSW Fair Trading has recently received complaints indicating that Mr Ungounga may be continuing to seek residential building work for which a contractor licence is required.

Mr Ungounga may be seeking work in Sydney metropolitan areas including the Kellyville, Carlingford and Castle Hill areas.

Consumers dealing with Mr Ungounga complain that they engage him to perform major residential building works, concreting or structural landscaping and that he demands cash upfront but leaves the works uncompleted.

Mr Ungounga has not ever held a contractor licence authorising him to contract or do residential building work. Mr Ungounga has previously contracted using T.T. Construction (an unregistered business name) and T & T Sandstone Construction Pty Ltd (a deregistered company).

Mr Ungounga was the subject of a Public Warning issued by NSW Fair Trading on 11 August 2020.

Mr Ungounga was also the subject of another Public Warning issued by NSW Fair Trading on 24 October 2018 , after he was ordered by a court to pay more than $56,000 in fines and costs for doing residential building work he was not authorised to do, including the construction of a new home for $350,000.

Anyone who has had concerns in their dealings in NSW with Mr Ungounga, or has information about his continued operation, should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

Consumers warned not to deal with the website discountepharmacy.com.au managed by David Le, trading as Chemist Max

NSW Fair Trading Commissioner, Rose Webb has warned consumers not to deal with discountepharmacy.com.au a website registered to and managed by Mr David Le, trading as Chemist Max.

The website discountepharmacy.com.au promotes the sale and supply of various health and wellbeing products, supplements, cosmetics and pain relief medications.

Ms Webb said the warning comes following a rise in complaints from consumers about not receiving goods paid for.

Consumers report that their pre-paid items do not arrive and claim that no explanation is provided by the trader for these delays, and that there is no financial redress offered.

Consequently, consumers have to seek a chargeback option from their banks where payments have been made via credit card.

Consumers have reported finding it very difficult to contact anyone at discountepharmacy.com.au to discuss the delays, and there does not appear to be a complaint handling process, making it difficult for concerns to be resolved.

Anyone who has dealt with the discountepharmacy.com.au website and is not satisfied with their interaction are urged to lodge a complaint with NSW Fair Trading.

Do not deal with Shervin Kalimi Chadorchi, presently associated with the Car Buying Agency Pty Ltd

Consumers are warned not to deal with Mr Shervin Kalimi Chadorchi, or his suspected aliases “Sean Chadouche” and “Michael Davidson” associated with The Car Buying Agency Pty Ltd (ACN 635785625) (the Trader) which operates as a broking service, sourcing motor vehicles for consumers via its website www.thecarbuyingagency.com.au.

The trader’s principal place of business is listed as Tower 1, International Towers, Level 35, 100 Barangaroo Avenue, Sydney.

NSW Fair Trading has received complaints about Mr Chadorchi (while involved with the trader) and those matters are currently under investigation.

Complaints relate to consumers who made contact with Mr Chadorchi through the trader’s website www.thecarbuyingagency.com.au.

The complainants received invoices purporting to be from large car dealerships which have included Mr Chadorchi’s personal bank account number. Consumers made payments to this account believing it to be the suppliers bank account.

It is reported that the motor vehicles are not supplied; refunds are only provided after extensive follow up from consumers; and on occasion, that consumers are provided with false bank payment receipts and emails purporting to be evidence of the processing of refunds when in fact the refunds have not been processed.

Refunds provided to date appear to be unreasonably delayed.

NSW Fair Trading understands that Mr Chadorchi was previously associated with Cars and Co Pty Ltd, being a company that was the subject of a public warning issued on 14 June 2019.

Customers who have dealt with Mr Shervin Kalimi Chadorchi, presently associated with The Car Buying Agency and are not satisfied with their interaction, are urged to contact NSW Fair Trading on 13 32 20.

Peter Hynes aka Todd Hynes aka Peter Garay

NSW consumers are again being warned not to deal with Peter Hynes, formerly known as Peter Garay, who also uses the name Todd Hynes.

NSW Fair Trading has received several complaints about Mr Hynes and these matters are currently under investigation.

Mr Hynes is known to knock on doors of houses in new housing estates offering to do landscaping work including retaining walls. Mr Hynes introduces himself as “Peter”, “Todd” or “Paul” and purports to be a legitimate tradesperson. Mr Hynes has not ever held a licence under the Home Building Act authorising him to contract for or perform any type of residential building work.

Mr Hynes has been prosecuted by Fair Trading on four occasions between 2003 and 2019. Mr Hynes was released from prison in late 2019, after being convicted of offences under the Home Building Act as the sole director of a company that contracted to do unlicensed building work, did uninsured building work and otherwise failed to do all the building work it was paid for .

NSW Consumers are being warned not to deal with Mehmet Onkun who also uses the name Mick Onkun and who is understood to trade through business names including Europe Cement Rendering, Europe Cement Rendering and Concrete, Illawarra Concreting and Constructions, Illawarra Concreting and Excavations and variations of those names.

NSW Fair Trading has many complaints about Mr Onkun and several of these matters are currently under investigation.

Mr Onkun does not hold a licence under the Home Building Act authorising him to contract for or perform residential building work.

The complaints received relate to consumers who contracted with Mr Onkun for various kinds of work including concreting, driveways, pathways, retaining walls, kitchen and bathroom renovations, fencing, rendering, tiling, and carpentry.

Consumers complain that work is performed without council approval (where Mr Onkun agreed to obtain relevant approvals) and that work is incomplete and unsafe. Consumers also complain that Mr Onkun has demanded large cash deposits for work and after receiving payment has not done the work and refused to refund the money.

Massoud Rassouli (also known as Michael Rassouli), trading as One Empire Fencing

NSW consumers are being warned not to deal with Massoud Rassouli (also known as Michael Rassouli) who trades under the business name One Empire Fencing. Mr Rassouli currently appears to be working predominantly in South Western Sydney.

Mr Rassouli does not hold a licence under the Home Building Act 1989 authorising him to contract for or perform residential building work.

NSW Fair Trading has received complaints about Mr Rassouli that are currently under investigation.

The complaints are from consumers who contracted with Mr Rassouli for fencing work. Consumers report that Mr Rassouli has demanded 50% deposits for work and after receiving payment has not done any work at all, and not provided a refund. Consumers also report that where work is done it is abandoned in a defective and incomplete state.

UBuild Containers Pty Ltd

NSW Fair Trading Commissioner Rose Webb has warned NSW Consumers not to deal with UBuild Containers Pty Ltd (Ubuild).

Fair Trading has received complaints about UBuild and several of these matters are currently under investigation.

UBuild does not hold a licence under the Home Building Act authorising it to contract for or perform residential building work.

The complaints received relate to consumers who contract with UBuild for pools and spas manufactured from used shipping containers.

It is reported that the goods are either supplied late, not supplied at all, or if the goods are supplied they are defective.

Anyone who has had problems in their dealings with UBuild should contact Fair Trading on 13 32 20 to lodge a complaint.

Do not deal with unlicensed pest controllers

NSW Fair Trading Commissioner Rose Webb has warned consumers not to deal with any persons or businesses offering pest control services using pesticides where those persons and businesses aren't properly licensed pest management technicians.

Ms Webb is reminding consumers to do their research when engaging service providers like pest controllers to make sure they are properly qualified and licensed; “Don’t just take their word for it - ask to see a copy of their licence. Look at reviews online and remember that if the price sounds too good to be true, it usually is.”

NSW Fair Trading has received consistent complaints about persons offering pest control services in circumstances where they are not licenced.

NSW Fair Trading has also received complaints about unsatisfactory pest control services provided by unlicensed operators.

A pest management technician licence issued under the Pesticides Act 1999 is required to use pesticides, or to carry on a business using pesticides, for fee or reward and in other circumstances.

Applications for a licence can be made to the New South Wales Environment Protection Authority.

Persons must have appropriate training and be assessed as fit and proper to be granted a pest management technician licence.

Licence holders are subject to stringent requirements to keep records and to notify others of pesticide use.

The misuse of pesticides can have very serious and harmful long term impacts on public health, domestic animals, wildlife and the environment.

Do not deal with Ms Zora Nawaz or Beastwear Pty Ltd trading as ‘Beastwear’

NSW Fair Trading Commissioner Rose Webb has warned consumers not to deal with Sydney businesswoman Ms Zora Nawaz or Beastwear Pty Ltd trading as ‘Beastwear’. Ms Nawaz is the sole director of Beastwear Pty Ltd.

Beastwear promotes the design, sale and supply of custom-made sports and performance clothing, uniforms and other garments via the website https://beastwear.com.au/ and also via their social media page at https://www.facebook.com/BeastwearAUS/

Complaints about Beastwear have been received by NSW Fair Trading including on behalf of not for profit organisations. Consumers dealing with Beastwear complain that items ordered and paid for in advance are not delivered or are significantly delayed and that Beastwear has a no refund policy. Consumers complain that the trader rarely responds to complaints.

Do not deal with A.C.N. 632 571 432 Pty Ltd t/as ‘Dos Facio Design’, Urban Couture Pty Ltd (ACN 162 945 995) and Thomas Towhidi

Consumers are warned not to deal with Sydney businessman Thomas TOWHIDI, director of A.C.N. 632 571 432 Pty Ltd t/as ‘Dos Facio Design’ and Urban Couture Pty Ltd t/as ‘Urban Couture’. Mr Towhidi promotes the sale and supply of boutique interior furniture, homewares, and contemporary European designs via social media sites and previously via the website ‘dosfaciodesign.com.au’.

Dos Facio Design aka ‘DFD Design’ appears to be operating from a warehouse facility in Alexandria NSW.

Consumers dealing with Dos Facio Design complain that they are faced with significant delays in the supply of goods paid for and in obtaining refunds, and claim to have extreme difficulty in contacting Mr TOWHIDI, or any Dos Facio Design staff regarding these delays.

Mr TOWHIDI is already known to NSW Fair Trading as the director of Urban Couture Pty Ltd t/as ‘Urban Couture’, which is subject of nearly 100 consumer complaints regarding lengthy delays in receiving items paid for.  NSW Fair Trading understands Urban Couture Pty Ltd was placed into voluntary administration on 06 March 2019 and is no longer trading, however on 28 March 2019, Mr TOWHIDI was appointed sole director of A.C.N. 632 571 432 Pty Ltd t/as ‘Dos Facio Design’, and similar complaints have been received from consumers as were received about Urban Couture.

Consumers are warned not to deal with Thomas TOWHIDI, Dos Facio Design or Urban Couture. If consumers have any other questions or concerns, they can contact NSW Fair Trading on 13 32 20.

Do not deal with Gtek Solutions

NSW Fair Trading Commissioner Rose Webb has issued a public warning to consumers not to deal with telemarketing company Gtek Solutions Pty Ltd, trading as ‘Gtek Solutions’ based in Sydney’s CBD.

Gtek Solutions business tactics include cold-calling consumers to sell printer ink cartridges and cleaning products.

We have received a number of complaints from people who report being pressured and harassed into accepting promotional office products. People are unaware they may be locked into an ongoing contract to purchase additional goods over several months and years into the future.

The business does not provide consumers with a written contract outlining any clear terms and conditions of the agreement, or their rights to a cooling-off period. Consumers are then issued an invoice demanding payment for the additional goods that they did not agree to purchase and have continued to receive.

The actions of Gtek Solutions may constitute breaches under the Australian Consumer Law regarding unsolicited consumer agreements.

Do not deal with Cars and Co Pty Ltd

NSW Fair Trading Commissioner Rose Webb has issued a public warning urging consumers not to deal with Cars and Co located at 71 Victoria Road, Rozelle NSW. Fair Trading has suspended Motor Dealers Licence held by Cars & Co Pty Ltd effective Tuesday 11 June 2019.

The trader’s business includes sourcing new and demonstrator vehicles from new car dealerships for fleet and private customers, as well as purchasing and selling second hand vehicles, including on consignment.

Fair Trading alleges the trader operates two bank accounts, however neither are trust accounts. Traders who conduct consignment sales without holding a trust account are in breach of section 90 of the Motor Dealers and Repairers Act 2013 (NSW).

It is alleged that the trader has failed to account to consignees the full amount received on the sale of vehicles, while the trader may have misappropriated money received on behalf of consignees to satisfy debts of the business – both of which are in breach of the Motor Dealers and Repairers Act.

Do not deal with True Filter Group Pty Ltd

20 March 2019

NSW Fair Trading Commissioner Rose Webb today issued a public warning urging consumers not to deal with online retailer True Filter Group Pty Ltd.

The online trader supplies water systems and accessories through three known websites: www.truwater.com.au, www.truwater.co.nz and www.budgetfridgefilters.com.

True Filter Group appeared on the Fair Trading Complaints Register three times in 2018 and has received over 120 complaints since September 2015.

Fair Trading has also received a range of complaints from consumers detailing their loss of money after dealing with the trader. The information received from consumers suggests True Filter Group is breaching a number of sections of Australian Consumer Law, which applies to transactions online in the same way it does in-store.

These contraventions include supplying generic products in the place of genuine brand name products, delays in the supply of goods, issues with cancellations and returns including a 25% restocking fee and storing credit card details and recharging customers months later.

Consumers who have complaints about dealings with True Filter Group should contact NSW Fair Trading on 13 32 20.

Do not deal with Scott John Moore, previously the Director of Great Directions Pty Ltd

NSW Fair Trading Commissioner Rose Webb has issued a public warning advising consumers not to deal with Scott John Moore, previously the Director of Great Directions Pty Ltd, a company now in liquidation.

Mr Moore and the company previously offered and accepted payment for hair loss treatment and skin rejuvenation. Fair Trading believes consumers have paid upfront for services yet have been unable to schedule those services.

It is believed that Mr Moore is continuing to use the company name without the consent of the Liquidator and customers who engaged Mr Moore’s business after its liquidation are yet to receive the service they paid for - or obtain a refund.

Fair Trading is reminding consumers to seek multiple quotes for any health and cosmetic procedures they are seeking.

Do not deal with Justin Glenn Hopper trading as ‘Hopper Blinds

NSW Fair Trading Commissioner Rose Webb today issued a public warning advising consumers not to deal with Justin Glenn Hopper or his business ‘Hopper Blinds’.

Hopper Blinds, a business name registered to Justin Glenn Hopper has been the subject of a number of complaints since 2017. Consumers have alleged that after paying a 50 percent deposit, Mr Hopper either failed to complete the work in a reasonable time, or didn’t do any work at all, and he rarely responded to phone calls from consumers.

Fair Trading is reminding consumers that a reasonable deposit prior to work starting is around 10 – 20 percent and consumers are within their rights to question what the deposit is for.

Do not deal with CDA Fencing Pty Ltd and Matthew Geoffrey Rixon

NSW Fair Trading Commissioner, Rose Webb, today issued a public warning advising consumers not to deal with CDA Fencing Pty Ltd and Matthew Geoffrey Rixon – or his suspected aliases “Matthew Douglas” and “Matt Douglas”.

This is one of many public warnings that Fair Trading has issued about Mr Rixon, after also bringing multiple court proceedings against the unlicensed tradesman.

“We have received several complaints about CDA Fencing Pty Ltd and Mr Rixon, including his aliases. The complaints indicate that Mr Rixon accepts deposits from his customers over the phone but fails to complete the agreed work or provide refunds,” Ms Webb said.

Fair Trading reminds consumers to only deal with licensed traders, if the work requires a licence.  Licences can be verified on Fair Trading’s website or by calling 13 32 20.

“We also remind consumers not to pay a deposit if they have not met the trader or if they have not carefully reviewed the trader’s quote,” Ms. Webb said.

Do not deal with Freedom Marine Services

Commissioner for NSW Fair Trading Rose Webb has issued a public warning advising consumers not to deal with Freedom Marine Services Pty Ltd and its Director, Deborah May Barron. Freedom Marine Services was primarily involved in the sale and repair of new and second-hand boats and trailers.

Several consumers were misled over the sale date and price of boats consigned to Freedom Marine Services and Fair Trading received complaints about delayed or partial payment and, in some cases, not receiving any proceeds at all.

Anyone who has had problems in their dealings with Freedom Marine Services and its Director Deborah May Barron, should contact NSW Fair Trading on 13 32 20 or lodge a complaint online.

Siaosi Liumaunu also known as ‘Siaosi Faatonu’ and trading using ‘OZI Fencing’, and ‘ALZ Fencing’

NSW Consumers are being warned not to deal with Siaosi Liumaunu also known as ‘Siaosi Faatonu’.

Fair Trading is concerned that Mr Liumaunu may be seeking to trade without a licence and noted he had never held a contractor licence in NSW.

Consumers should only deal with licensed traders, and emphasised the need for consumers to check a licence online or call 13 32 20.

ARVS or sole director Mr Seong Ho ‘Sean’ Park and Mr Edward ‘Ted’ Kang

NSW consumers are being warned not to deal with the business Australian RSMS Visa Service Pty Ltd, trading as ARVS, and its sole director Seong Ho ‘Sean’ Park.

NSW Fair Trading Commissioner Rose Webb is issuing the public warning against ARVS after it was found the business is offering visa and immigration services to consumers, but not delivering the service despite being paid.

Fair Trading is urging anyone who has experienced problems in their dealings with Mr Seong Ho ‘Sean’ Park, Mr Edward Kang, or AVRS, to contact NSW Fair Trading on 13 32 20, or lodge a written complaint online.

Tevita Tiliti Ungounga

NSW Consumers are being warned not to deal with Tevita Tiliti Ungounga or his associated entities T.T. Construction, an unregistered business name in NSW, and T & T Sandstone Construction Pty Ltd operating in NSW.

Mr Ungounga was ordered in September 2017 to pay more than $56,000 in fines and costs for doing residential building work he was not authorised to undertake, including the construction of a new home for $350,000.

Mr Ungounga has never held a contractor license authorising him to contract or do residential building work, while T.T. Construction is an unregistered business name and T & T Sandstone Construction Pty Ltd is a deregistered company.

Anyone who has had problems in their dealings in NSW with Mr Ungounga, T.T. Construction and T & T Sandstone Construction Pty Ltd, or has information about his continued operation, should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

NSW consumers are being warned not to deal with the company Hunterstone Australia and its sole director Azad Mortazavi.

Fair Trading is concerned that Mr Mortazavi and his business Hunterstone Australia is accepting full upfront payments from consumers, but failing to deliver products.

Fair Trading urges anyone who has had problems in their dealings with Mr Mortazavi and Hunterstone Australia to contact NSW Fair Trading.

Anthony Lee Francis aka Tony Francis, Tiger Concrete and Tiger Concrete and Excavation Group

NSW Fair Trading Commissioner Rose Webb today warned consumers not to deal with Anthony Lee Francis also known as Tony Francis who has traded in NSW under the business name Tiger Concrete and Excavation Group.

Mr Francis does not hold a current NSW contractor licence and Fair Trading is concerned that Mr Francis may be seeking to trade without a licence. Mr Francis seeks residential building work, mainly general concreting including driveways and footpaths. In some cases, after contracting for the work and accepting payment, Mr Francis leaves the work incomplete, does not perform any work at all, and then fails to refund consumers their money.

Anyone who has had problems in their dealings with Mr Francis and his association to any trading names, or has information about his continued operation should contact NSW Fair Trading.

Allan James Piggott

Consumers are being warned not to deal with Allan James Piggott, also known as Allan Chisel. Mr Piggot contracts to do unlicensed and uninsured work under various unregistered business names. In many cases the work he does is defective.

Mr Piggott has recently been seeking concreting, paving and structural landscaping work in the Sydney suburbs of Blacktown, Seven Hills, St Clair, Rooty Hill, Minchinbury, Stanhope Gardens, Chatswood and on the Central Coast.

Warning over lead in Hashmi eyeliner

A public warning has been issued by Minister of Better Regulation, Matt Kean, about an imported cosmetic eye liner, which has dangerous levels of lead and may have caused three children to become sick.

Testing of the imported cosmetics, including Hashmi Surmi Special and Hashmi Kohl Aswad eyeliners, revealed an 84 per cent lead content. The products also contained high levels of dangerous metals like arsenic, cadmium, chromium and mercury. The eyeliners were manufactured in Pakistan and NSW Fair Trading had also referred the products to the Australian Border Force for investigation.

Traders are also being warned that supplying products that do not comply with the Mandatory Standard is an offence under the Australian Consumer Law, punishable by a fine of up to $1,100,000 for a body corporate or $220,000 for an individual.

NSW Health advises that people who have these products should cease using them immediately, and seek medical advice from their local doctor as soon as possible.

Nader Soliman

Consumers are being warned not to deal with Nader Soliman, an unlicensed motor dealer who continues to trade despite being disqualified.

Soliman also goes by Youssef Soliman and Joseph Soliman, and is known to trade under the company names of All Over Wholesalers Pty Ltd, Consolidated Automotive Group Pty Ltd and is known to operate in association with EG & Y Group Pty Ltd.

Fair Trading investigations into Soliman are continuing. Meanwhile, consumers who are aware of Soliman, or any of the above-named entities, advertising or selling motor vehicles are urged to contact Fair Trading.

Jack Younes

9 July 2018

Consumers are being warned not to deal with unlicensed contractor Jack Younes, who was recently convicted and fined $75,000 over home building and consumer law offences.

Younes, whose aliases include Charlie Khouri, Jason Tippett and Jack Tan, has traded in Western Sydney under various company and business names such as Universal Constructions & Landscapes Pty Ltd, Dreamscapes and Ikon (or Icon) Landscape Constructions.

Anyone who has had problems in their dealings with Younes or his companies, or has any information about his continued operations, should contact NSW Fair Trading on 13 32 20 to lodge a complaint.

Younes was convicted on 29 June 2018 in Parramatta Local Court. He has 28 days to appeal his conviction.

Peter Todd Hynes and Captain Trade Group

Consumers are being warned not to deal with Peter Todd Hynes and Captain Trader Group Pty Ltd.

Mr Hynes, previously known as Peter Garay, is an unlicensed trader who was previously convicted, and jailed, for home building offences. Consumers are urged to report any issues with this trader to NSW Fair Trading.

Goldman Pintex

Consumers have been warned not to deal with North Sydney based migration agency, Goldman Pintex Management Pty Ltd, trading as Goldman Pintex Migration at Suite 401, Level 4/80 Mount Street, North Sydney.

The warning also applies to the company's sole director, Yoon Seok 'Joseph' Choi. The company targets consumers seeking a Temporary Work Visa (subclass 457). Choi and his associates claim they will find a business sponsor for clients and lodge a work visa application with the Department of Immigration and Border Protection in exchange for a hefty fee of up to $60,000, which is to be paid in installments by the consumer. In several cases, where an application was denied, the trader failed to refund installments already paid.

Fair Trading inquiries have revealed one of the company's associates is Edward 'Ted' Kang, who was convicted on 28 March 2017 of multiple fraud offences and sentenced to up to 12 months jail. Kang is on conditional bail awaiting a District Court appeal against his sentence and conviction.

Kang was accused of running a similar dodgy visa racket, and Fair Trading believes he is involved in this one as well.

Viagogo

Consumers have been warned about using online ticket reseller Viagogo after NSW Fair Trading had received 187 consumer complaints, and 237 enquiries, about the Swiss-based ticket exchange platform.

Complaints to-date have included delayed delivery, events being cancelled, heavily marked-up prices, hidden fees, and failure to provide refunds.

Viagogo has also appeared on Fair Trading’s monthly Complaints Register eight times between November 2016 and July 2017, and was in the top five most complained about traders on five occasions.
