About enforceable undertakings
We may take enforcement action against individuals or companies that contravene Fair Trading laws.
Enforcement action is designed to stop unlawful conduct, reduce the likelihood of its recurrence, act as a general and specific deterrent and where appropriate, reverse its effect through actions such as corrective advertising or compensation.
We have authority under the Australian Consumer Law and other NSW legislation, to accept enforceable undertakings by the offending parties.
Enforceable undertakings provide a swift, flexible, and cost effective resolution. They don't need court approval but can be enforced by the courts where there is a failure to comply.
Terms of an undertaking are negotiated between Fair Trading and offending parties.
Enforceable undertakings can be a beneficial option as consumers receive redress quickly and Fair Trading and the trader co-operate to reach a reasonable solution and prevent future non-compliance.
