Remake of the Community Land Management Regulation 2018

    The NSW Government is remaking the Community Land Management Regulation 2007, which will be automatically repealed on 1 September 2018.

    A proposed Community Land Management Regulation 2018 and an accompanying Regulatory Impact Statement has been prepared for public consultation. The proposed Regulation supports the Community Land Management Act 1989.

    There are 3 types of schemes under the community land laws – community, precinct and neighbourhood schemes. The Regulation provides the administrative detail needed to ensure the effective operation of the Community Land Management Act.

    Reforms of community schemes laws are currently underway to achieve consistency with the strata schemes laws which started on 30 November 2016.

    Achieving better consistency of the requirements under the strata scheme management laws and the community land management laws will assist those who work with both types of property schemes. As strata schemes often exist within a community land scheme, this may also help strata residents to better understand their rights and obligations.

    At this time, it is intended that the Regulation will be remade without any changes.

    Following a major review of community schemes laws, a Community Schemes Law Reform position paper outlining proposed reforms was released. Once the reforms have been passed by the NSW Parliament, there will be a major review of the Community Land Management Regulation.

    However, submissions on this consultation are still welcome and will be considered during both this review and the next review of the Regulation.

    Stakeholders and interested parties are invited to review the proposed draft Regulation, and accompanying Regulatory Impact Statement, and provide any comments.

  • Milestones

    • 1 August 2018: submissions close (5pm)
    • From 2 August 2018: we will review and analyse all submissions and feedback
    • Before 1 September 2018: the final Regulation will be published on the NSW legislation website
    • 1 September 2018: the Regulation commences
