Why we collect your personal information

The Department of Customer Service (the Department) on behalf of the Commissioner for Fair Trading, gives priority to protecting the privacy of your personal information. We do this by handling personal information in a responsible manner and in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

The personal information you provide in this registration is collected and held by NSW Fair Trading as part of the registration process for the E-Audit portal.

We are collecting your personal information for the following purposes:

  1. To confirm you are qualified to act as an auditor pursuant to section 115 of the Property and Stock Agents Act 2002 (PSAA) or section 79 of the Conveyancers Licensing Act 2003 (CLA).
  2. To provide you access to the E-Audit portal and allow you to lodge audit results with Fair Trading pursuant to Part 7 and Part 8 of the PSAA and the Property and Stock Agents Regulation 2022 or Part 5 and Part 6 of the CLA and Conveyancers Licensing Regulation 2021.
  3. Internal administrative purposes, including liaising with you if there are any issues with your registration
  4. We may use the information to support more informed policy making, program management, evaluation, research and service planning as it can facilitate more efficient service delivery in NSW.
  5. Other directly related purposes.

Failure to provide information

Providing this personal information is voluntary, however, the consequence of not providing it is that you may not be able to be registered for the portal.

How we may use this information

We may use the personal information in your registration to complete your registration for the portal and allow you to submit an auditor’s report. We may also use the personal information you provide to update your details.

We will store and manage your personal information in accordance with the provisions under the PPIP Act. This being the information is to be kept for no longer than necessary for the purposes of which the information may lawfully be used. The information is disposed of securely, protected by taking reasonably necessary safeguards against any loss, unauthorised access, use, misuse, modification or disclosure and against all other misuse of information.

How we may disclose this information

We will not use or disclose your personal information unless you have given consent, we are authorised or permitted to do so by law or as required by section 219 of the PSAA or section 161 of CLA.
