Why we collect your personal information

The Department of Customer Service (the Department) on behalf of the Commissioner for Fair Trading, gives priority to protecting the privacy of your personal information. We do this by handling personal information in a responsible manner and in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

The personal information you provide in this registration is collected and held by NSW Fair Trading as part of the registration process for the E-Audit portal.

We are collecting your personal information for the following purposes:

  1. To process an auditor’s report on the audit of a trust account pursuant to Part 7 and Part 8 of the Property and Stock Agents Act 2002 (PSAA) and the Property and Stock Agents Regulation 2022 or Part 5 and Part 6 of the Conveyancers Licensing Act 2003 (CLA) and Conveyancers Licensing Regulation 2021.
  2. To confirm that the licensee has complied with the relevant Act’s and Regulation’s in all material aspects.
  3. To confirm authority of the auditor to act on behalf of the licensee.
  4. To update the details of an auditor within the portal as required.
  5. Internal administrative purposes, including liaising with the auditor to discuss queries relating to their report on the audit.
  6. We may use the information to support more informed policy making, program management, evaluation, research and service planning as it can facilitate more efficient service delivery in NSW.
  7. Other directly related purposes.

Failure to provide information

Providing this personal information is voluntary, however, the consequence of not providing it is that an auditor’s report of a trust fund under the PSAA or the CLA may not be processed.

How we may use this information

We may use the personal information provided to confirm the licensee has handled trust money in accordance with the PSAA or CLA and the corresponding Regulation's. We may also use this to take necessary action against a licensee whereby such report indicates a contravention of either the PSAA or the CLA and the corresponding Regulation's.

We will store and manage your personal information in accordance with the provisions under the PPIP Act. This being the information is to be kept for no longer than necessary for the purposes of which the information may lawfully be used. The information is disposed of securely, protected by taking reasonably necessary safeguards against any loss, unauthorised access, use, misuse, modification or disclosure and against all other misuse of information.

How we may disclose this information

We will not use or disclose your personal information to anybody else unless you have given consent, we are authorised or permitted to do so by law or as required by section 219 of the PSAA or section 161 of the CLA.
