How we handle your personal information when you register for and use the MyInspections gateway.

Who we are

Your information is being collected by the Department of Customer Service (the Department) on behalf of the Commissioner for NSW Fair Trading. NSW Fair Trading gives priority to protecting the privacy of personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

Why we collect your personal information

NSW Fair Trading is collecting personal information for the purpose of registering you for the MyInspections gateway and providing you access to pay fees and submit documents in accordance with the Plumbing and Drainage Act 2011 (P&D Act), Plumbing and Drainage Regulation 2017 (P&D Reg) or the Gas and Electricity (Consumer Safety) Act 2017 (G&E Act) and the Gas and Electricity (Consumer Safety) Regulation 2018 (G&E Reg).

The kinds of information we collect

We may collect the following information:

  • Your first and last name, contact details (address, email and phone numbers) and licence information
  • Property details
  • The information of third parties, such as supervisors, property owners and vehicle owners, network operators and gas suppliers
  • Additional personal information if it is required to process your applications throughout the gateway.

Failure to provide information

You are legally required to submit certain documents with NSW Fair Trading and failure to do so may result in enforcement action. Some personal information that you provide is voluntary, however, without this, we may be unable to process your applications.

How we may use this information

We may use the information we collect in the following ways:

  • To register you for the gateway and provide you access to the services it offers.
  • To assess the information and documents you provide in the gateway and ensure the plumbing, drainage and/or gas work conducted is compliant with the requirements of the P&D Act and P&D Reg or the G&E Act and G&E Reg.
  • To process payments of the relevant fees in accordance with the type of plumbing and/or drainage work being conduct.
  • Internal administrative purposes, including liaising with you in relation to your submissions in the gateway, updating your details in the gateway and in relation to compliance, investigations, and enforcement of the P&D Act and P&D Reg or the G&E Act and G&E Reg or the Fair Trading Act 1987.
  • To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for residents and business in NSW.
  • Other directly related purposes.

Who we may share your information with

If required, we may make enquiries and exchange information with other NSW Government agencies, or other States, Territories and/or the Commonwealth for the purposes of assessing your application and for compliance purposes. We may disclose your information to such bodies for these purposes.

Where there is an actual or potential public health risk, we may disclose your information to Sydney Water or Hunter Water in line with a current memorandum of understanding (MOU).

For gas certificates of compliance or inspection, such information may be disclosed to the network operator or gas supplier.

We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. Our Privacy Statement describes when this may occur.

Protecting your information

We will store and manage your personal information in accordance with the provisions under the PPIP Act.  We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.

We will only keep information for as long as we need it to fulfil the purposes we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
