Elderton Homes

Elderton Homes Pty Ltd trading as Elderton Group has been placed into external administration with O’Brien Palmer appointed as Administrators.

The Administrator now manages the company and will review their financial position to determine whether they can continue to trade or will be liquidated. This process will take some time and the Administrator has indicated they will provide an overview of the company’s position before the end of December 2022.

Customers who have been impacted are advised to:

Homeowners who have paid deposits, have work in progress or have outstanding rectification work required under warranty should contact the Administrator to be listed as an unsecured creditor.

2. Check and claim under the home building compensation scheme

Homeowners in NSW may be protected through the home building compensation scheme. icare Home Building Compensation (HBC) Fund is the insurer responsible for home building compensation in NSW.

As the company is now under administration, homeowners with valid cover may be entitled to claim if their building work is incomplete or has defects. Should the external administration lead to the successful restructuring of Elderton Homes, concerns about incomplete or defective building work can then be pursued through the business directly.

To check you have cover, you can use the State Insurance Regulatory Authority (SIRA) HBC Check. You can search by property address, the certificate number (if known), or by the name or licence number of the contractor.  As the regulator of the home building compensation scheme, SIRA is closely monitoring the situation to ensure that impacted homeowners are made aware of their entitlements.

3. Lodge a complaint with Fair Trading

NSW Fair Trading regulates residential building work in NSW. We have a range of regulatory options available when conduct issues and breaches of legislation occur. However, the actions available to Fair Trading will depend on the outcome of the administration process.

In the interim, if you are a customer of Elderton Homes we encourage you to lodge a complaint with us to:

  • be kept informed as the administration progresses
  • arrange an inspection of outstanding rectification work on completed homes to assist in your claim
  • advise us if you do not have cover under the home building compensation scheme.
